This an application under section 439, Cr.P.C. for release of the petitioner who is in custody in connection with Bisra P.S. No.99 of 2016 corresponding to Spl. G.R. Case No.75 of 2016 pending in the court of the learned Sessions Judge-cum-Special Judge, Sundargarh running for the alleged commission of offence under sections 376(2)(i)/506, I.P.C. read with section 6 of the POCSO Act has been filed on 04.10.2017.
In view of the order dated 14.11.2017 passed by this Court in BLAPL No.632 of 2017, which had been filed on 24.01.2017, the present application does no more survive for consideration.
In view of the above, the application giving rise to BLAPL No.7562 of 2017 also does no more survive.
