Learned counsel for the petitioner submitted that the health condition of the mother of the petitioner Nayana Gotan is not good and the petitioner may be granted interim bail for looking after the health condition of his mother.
Learned counsel for the State was earlier directed to obtain instruction. Today, learned counsel for the State has produced the letter dated 11.03.2019 of the Inspector incharge, Jeypore Sadar Police Station, which indicates that the concerned officer personally visited the house of the petitioner and on enquiry, he found that the mother of the petitioner is suffering from Dysfunctional Uterine bleeding (DUB) with Pelvic inflammatory disease (PID) since last six months and was undergoing treatment at DHH, Koraput at Jeypore and since then she is feeling sick and her health condition is poor. The concerned police officer has also annexed the medical documents with his report.
Considering the submissions made by the learned counsels for the respective parties, the grounds taken in the interim application and the report of the Inspector in-charge, Jeypore Sadar Police Station and the medical documents, I am inclined to release the petitioner on interim bail for a period of one month from the date of release.
The learned Court in Seisin over the matter shall release the petitioner on interim bail for the aforesaid period in connection with Jeypore Sadar P.S.Case No.119 of 2017 corresponding to T.R.Case No.29 of 2017 pending in the Court of learned Sessions Judge-cum-Special Judge, Jeypore at
Koraput on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent local sureties each for the like amount to his satisfaction with further terms and conditions as the learned Court may deem just.
The petitioner shall surrender after the interim bail period. The BLAPL is accordingly disposed of.
Issue urgent certified copy as per Rules in course of the day.
