This application under Section 438 Cr.P.C. has been made on 30.05.2019 by the petitioners apprehending arrest in connection with Tangi P.S. Case No.108 of 2019 corresponding to G.R. Case No. 921 of 2019 for the offence under Sections 341/294/323/325/506 and 34 of IPC pending in the court of learned J.M.F.C. (R), Cuttack.
Heard learned counsel for the petitioners and learned Addl. Government Advocate.
The petitioners are the permanent inhabitant of village-Gokulpur, P.S.-Tangi, Dist-Cuttack and there is no chance of fleeing from justice. State does not show any criminal antecedent of the petitioner or previous involvement in any case.
Regard being had to the above attenuating circumstances, it is felt just and proper to extend the privilege of Section 438 Cr.P.C. to the petitioners.
Hence, it is ordered that in the event of arrest of the petitioners namely Bhikari Charan Jena, Ranjana Jena and Bharati Jena in connection with the above noted case, they shall be released on bail by executing bail bond of Rs.20,000/- (Rupees twenty thousand) each with one surety each for the like amount to the satisfaction of the Arresting Officer, subject to the conditions that; (1) they shall appear before the I.O. as and when to be directed by him for the purpose of investigation and (2) they shall not directly or indirectly make any inducement, threat or promise to any persons acquainted with the facts of the case.

Violation of any of the above conditions shall entail cancellation of bail without reference to this Court.
The ABLAPL is accordingly disposed of.
