The petitioners in this case having been implicated in Marsaghai P.S. Case No.32 of 2018 corresponding to G.R. Case No.236 of 2018, pending in court of learned S.D.J.M., Kendrapara for alleged commission of offences punishable under Sections 294, 341, 323, 354, 354-B, 307, 379/34 of I.P.C., have filed this petition for their release on pre-arrest bail.
Heard learned counsel for the petitioners and the learned counsel for the State.
It is stated charge-sheet in this case has already been filed.
Regard being had to the facts and submissions made, especially the nature of accusation, circumstances in which the offences alleged to have been committed, also the fact that the matter arises out of civil dispute and custodial interrogation of the petitioners is not essential for further investigation of the case, as submitted by the learned counsel for the State and hardly any material being there to suggest that the petitioners are likely to abscond or tamper with the prosecution evidence, if released on pre-arrest bail, this Court directs that if the petitioners surrender before the Court in seisin over the matter within four weeks’ hence and make a motion for bail, the Court concerned shall release them on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper.
The ABLAPL is, accordingly, disposed of.
