Heard learned counsel for the parties.
By way of this writ petition, the petitioner has challenged the order dated 18.08.2009 passed by the Central Administrative Tribunal in O.A. 458 of 2006, whereby the Tribunal has dismissed the original application taking into consideration the law prevailing as on today and the death of the employee was on 10.04.1995. The tribunal, while considering the matter, in paragraph-7 of its order observed as under:
“7. From the discussions made above, it is evident that there has been no application of mind in judging the case of the Appliant and the impugned order so far it relates to applicant is quashed and the Respondent no.2 is hereby directed to consider the case of the applicant taking into consideration his indigent condition keeping in mind the decision of the Hon’ble High Court made in the case of Purna Chandra Swain (Supra) within a period of 60 days from the date of receipt of a copy of this order”
We are in complete agreement with the view taken by
the tribunal. No case is made out by the petitioner.
