02. 28.11.2018 Heard learned counsel for the petitioner.
Learned counsel for the petitioner submits that the petitioner was availed a loan from IndusInd Bank Ltd., opposite party no.2 to purchase TATA LPK. He has defaulted in payment of instalments amounting to Rs.3,00,000/- (Three lakhs). He further submits that the petitioner is ready and willing to pay the outstanding dues provided a reasonable time is given.
Considering the submission of learned counsel for the petitioner, the petition is disposed of with a direction to the petitioner to pay an amount of Rs.1,00,000/- (Rupees One Lakh) by 15th December, 2018. Rest of the amount shall be paid in two installments by end of January, 2019. In addition to the same, the petitioner shall go on paying the current dues. After payment of first instalment, opposite party no.2 shall release the vehicle in favour of the petitioner. It is made clear that no further extension of time shall be given.
Since the petition is disposed of at the stage of admission, it is open to the opposite party no.2 to file an application for review/recall the order, if it so likes.
