Though the matter was listed for orders, on the consent of the parties, the same is taken up today for final disposal.
Heard Ms. Savitri Ratho, learned counsel for the petitioner and Mr. A.S. Nandy, learned counsel appearing for the opposite party no.1.
This petition challenges the order dated 15.02.2014, passed by the learned Civil Judge (Senior Division), Angul, in C.S. No.61 of 2013, whereby and whereunder, the learned trial Judge rejected the application of the petitioner filed under Order 1 Rule 10(2) C.P.C. for impleadment.
Mr. Nandy, learned counsel for the opposite party no.1 submits that he has no objection if the petitioner is impleaded as defendant in the suit.
In view of the consent of learned counsel for the opposite party no.1, the petition is allowed. The petitioner be impleaded as defendant in the suit.
Since the evidence from the side of the plaintiff is closed, learned trial Judge is directed to dispose of the Civil Suit No.61 of 2013 as expeditiously as possible, preferably by end of March, 2019.
