The petitioners being in custody in connection with Mudilipada P.S. Case No.40 of 2018 corresponding to T.R. Case No.128 of 2018 pending in the court of the learned Sessions Judge-cum-Special, Malkangiri running for the alleged commission of offence under section 20(b)(ii) of NDPS Act, have filed this application under section 439, Cr.P.C. for their release on bail.

Heard learned counsel for the petitioners and learned counsel for the State.

Considering the submissions made and on going through the materials available on record including the quantity of contraband ganja said to have been seized; further keeping in view the surrounding circumstances including the period of detention of the petitioners in custody and in the absence of any other impediment, it is directed that the petitioners be released on bail in the aforesaid case with such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that:-

i) they shall not fail to appear in person before the court in seisin of the case on three consecutive dates;

¶7

ii) shall file affidavit giving their permanent and present address along with contact mobile number; and

¶8

iii) shall appear before the OIC of Bhagyanagar Taroda Naka Police Station in the district of Nanded (Maharastra) in every Sunday in between 10.00 A.M. to 2.00 P.M. for a period of next six months.

The BLAPL is accordingly disposed of.
