19.12.2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners in this case having been implicated in Jarapada P.S. Case No.196 of 2018 corresponding to G.R. Case No.1921 of 2018, pending in the court of the learned S.D.J.M., Angul for alleged commission of offences punishable under Sections 143/147/341/285/353/ 332/336/337/435/186/431/294/506/307/427/120B/149 of IPC read with Section 3 P.D.P.P. Act and 7 Cr.L.A. Act have filed this petition for their release on pre-arrest bail.

Regard being had to the facts and submissions made, especially the nature of accusation, character of supportive materials appearing against the petitioners in support of the charge, circumstances in which the offences alleged to have been committed, factum of substantial progress of investigation and hardly any material being there to suggest that the petitioners are likely to abscond or tamper with the prosecution evidence, if released on bail, I am of the view that the petitioners in this case deserve to be released on pre-arrest bail.

Hence, this Court directs that in the event of arrest of the petitioners in connection with the aforesaid case, they be released on bail by the arresting officer on such terms and conditions as he may deem just and proper including the condition that the petitioners shall cooperate with the investigation.

However, it is made clear that if any graver offence is found against the petitioners in this case besides the aforesaid offences, this order shall not be given effect to.

Accordingly, the prayer for pre-arrest bail stands allowed and the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
