Learned counsel for the petitioner submits that the death in the case has taken place because the deceased committed suicide by hanging. Referring to the forwarding report, he submits that it has been ascertained in course of the investigation that after hot exchange of words between the deceased and her inlaws for sometime in the evening, she all of a sudden entered into the bedroom, locked it from inside and hanged herself by means of a saree from the ceiling fan. He further submits that the husband of the deceased having been arrested, is now on bail and the witnesses have stated that the petitioner and other family members including the husband of the deceased had immediately broken the door and rescued her. In view of this, he urges for grant of bail to the petitioner.
Learned State counsel opposes the move.
Considering the submissions and viewing the nature of accusations against the petitioner as well as other surrounding circumstances, it is directed that in the event petitioner surrenders before the court in seisin of the case in connection with Airfield P.S. Case No.266 of 2018 corresponding to C.T. Case No.3744 of 2018 pending on the file of the learned S.D.J.M., Bhubaneswar within two weeks hence and moves for his release on bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.
