Learned counsel for the petitioner submits that this petitioner is the father of the principal accused and has no connection with the alleged commission of the principal offence and he has been arraigned in the case assigning the role at a much later stage.
Learned counsel for the State opposes the move.
Considering the submissions and viewing the nature of accusations against the petitioner as well as other surrounding circumstances, it is directed that in the event petitioner surrenders before the court in seisin of the case in connection with Mahakalapada P.S. Case No.159 of 2016 corresponding to G.R. Case No.1082 of 2016 on the file of learned Addl. Dist. & Sessions Judge-cum-Special Judge, Kendrapara within two weeks hence and moves for his release on bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.
The ABLAPL is disposed of.
