It is stated by the learned counsel for the opposite party no.1-Bank that this matter
is now subjudice before the learned Debts Recovery Tribunal, Odisha, Cuttack.
In view of the aforesaid, this Court is not inclined to entertain this writ petition a
nd, as such, vacates the interim order dated 17.05.2017 passed in Misc. Case No.702 of 2017.
However, it is submitted by the learned counsel for the petitioner that the petitioner
is ready and willing for One Time Settlement of his loan account. Considering such submission
, it is observed that if such proposal is given to the opposite party no.1-Bank by the petitio
ner in writing, the Bank concerned shall consider such proposal and take an informed and consi
dered decision in the matter within fifteen days of its filing, in accordance with law.
With the aforesaid observation, this writ petition is disposed of at the stage of admi
ssion.
