This application has been filed by the opposite parties who are the legal heir
s of one Kumud Kalo who had approached the Tribunal in SBP 1/93(O.A. No. 131/1993). The Tribun
al allowed the original application on 19.9.2007 and directed the RDC to workout the arrear en
titlement of the deceased applicant as due and admissible and other service and financial bene
fits. The applicant had died during pendency of the original application and his legal heirs a
re impleaded in his place.
Challenging the said order of the Tribunal the State Government had filed the
writ petition which was dismissed on 21.6.2017. However the benefit which was directed to be e
xtended to the legal heirs of the deceased employee has not yet disbursed for which the presen
t misc. case is filed.
Since the writ petition was dismissed, as submitted by learned Addl. Governmen
t Advocate in case the order has not been complied with the same shall be complied within a pe
riod of eight weeks, we dispose of the misc. case directing the petitioner to disburse the fin
ancial benefits to the legal heirs of the deceased employee by end of February, 2018.
Issue urgent certified copy.
