Heard Mr. Mishra, learned Senior Advocate for the petitioner and learned coun
sel for Khurda Central Co-operative Bank Ltd.
This review petition has been filed for review of the order dated 11.12.2006 p
assed in O.J.C. No. 14903 of 2001.
We do not find any ground to review the aforesaid order passed by this Court.
However, it is submitted by learned counsel for the petitioner that the order
of this Court has not been complied with. He has referred to the order dated 31.03.2010 passe
d by the Secretary, Khurda Central Co-operative Bank Ltd., under Annexure-C to the Additional
Affidavit filed by the petitioner. On perusal of the said order, it reveals that the Secretar
y has communicated the following intimation.
So, we are unable to consider your application dated 03.06.2009 once again bas
ing upon the order passed by the Honble High Court of Orissa in OJC No. 14903 of 2001.
The aforesaid intimation of the Secretary does not amount to compliance of the
order of this Court. Thus, we direct the said opposite party no.5 to comply the order of thi
s Court dated 11.12.2006 passed in O.J.C. No.14903 of 2001 within a period of four weeks on pr
oduction of the certified copy of the order.
The RVWPET is accordingly disposed of.
