2. In view of the order this Court proposes to pass, it is not necessary to issue notice to th
e Chief Executive Officer, Balasore-Bhadrak Central Cooperative Bank Ltd., Balasore, opposite
party no.3.
3. It is borne out from the record that the petitioner is an employee of Balasore-Bhadrak Cent
ral Co-operative Bank Ltd., Balasore. His name has been reflected in the Gradation List of Ban
king Assistant published under the authority of the then Executive Officer of the aforesaid Ba
nk. The grievance of the petitioner is that the gradation list published by the Bank on 31.3.2
008 reveals the actual date of joining/entry of the Banking Assistants (Junior Supervisors) wh
ereas the present gradation list, which has been issued on 7.12.2016, does not conform to t
he date of joining of the aforesaid employee as per their service book maintained in the Ban
k for which the seniority has been refused under violation of the principle of natural justice
. His representation has not been disposed by opposite party no.3 as yet.
4. In that view of the matter, this Court disposes of the writ petition directing opposite par
ty no.3 to examine the representation of the petitioner as at Annexure-4 and take a decision s
trictly in accordance with law and dispose of the same by a reasoned order after affording rea
sonable opportunity of hearing to the petitioner and all parties concerned within a period of
thirty days from the date of receipt of certified copy of this order as well as the copy of th
e brief. Opposite party no.3 shall act upon production of certified copy of this order.
5. Learned counsel for the petitioner undertakes to file the certified copy of this order as w
ell as the copy of the brief before opposite party no.3 within a period of seven days.
6. Urgent certified copy of this order be granted on proper application.
