rties.
The petitioner is aggrieved by the demand notice dated 10.02.2017 levying tax
and asking him to file show cause U/S. 13 (2) of the Motor Vehicle Taxation Act in respect of
the vehicle bearing Registration No. OR-04-B-1693 (Truck).
The petitioner is agreeable to pay the amount so far as tax is concerned. Lear
ned counsel for the petitioner proposes that the petitioner shall file show cause U/S. 13 (2)
of the aforesaid Act, so far as penalty is concerned.
Taking into consideration such submission, the writ application is disposed of
, directing the petitioner to pay the amount of tax before the R.T.O.-cum-Taxing Officer, Chan
dikhole within thirty days from today and so far as penalty is concerned, the petitioner is di
rected to file show cause U/S. 13 (2) of the Motor Vehicle Taxation Act before the Opp. Party
within the aforesaid period. On payment of tax, the Certificate of Fitness and Permit shall be
granted in favour of the petitioner, if there is no other legal impediment.
The writ application is accordingly disposed of.
