Learned counsel for the petitioner submits that the claim of the petit ioner is squarely covered by the ratio decided in the case of Pradipta Kumar Sutar and Debendr anath Barik (supra) affirmed by the Apex Court in SLP No. 18170-18171 of 2014. He further subm its that although highlighting the grievance, the petitioner has made a representation to oppo site party no. 1 vide Annexure-6 yet no decision has been taken by now. He therefore urges fo r disposal of the writ application with necessary direction for consideration and disposal of the said representation of the petitioner.

Mr. Panda, learned Additional Standing Counsel submits that the facts and circumstances of the case require to be examined in detail in finally saying as to whether the representation of the petitioner merits consideration or not. Considering the aforesaid limited nature of submission, without expres sing any opinion on the merits of the claim of the petitioner this Court disposes of the writ petition directing opposite party no. 1 to consider the representation stated to have be en field by the petitioner vide Annexure -6, and if it is still pending on its own merit and dispose it of in accordance with law within a period of six months from the date of communicat ion of this order or production of its certified copy whichever is earlier.
