Heard Mr. Mahunta, learned counsel for the petitioner and Mr. Samal, learned Standing
Counsel for the School & Mass Education Department.
The grievance of the petitioner is that though he is eligible to be appointed as part
time instructor in the sports quota, but his case has not been considered.
Mr. Mahunta, learned counsel for the petitioner submits that though the petiti
oner has filed a representation to the Director Sports and Youth Service Department, Bhubanesw
ar opposite party no.2 vide Annexure-9, however, he submits that liberty maybe granted to the
petitioner to file a fresh representation before the District Project Coordinator, Sarva Siks
hya Aviyan, Ganjam-opposite party no.3 highlighting all his grievances. He further submits tha
t a direction may be issued to the opposite party no.3 to dispose of the representation within
a specific time period.
Considering the submissions made and without expressing any opinion on the mer
its of the case, this Court grants liberty to the petitioner to file a representation highligh
ting all his grievances before opposite party no.3 within a period of two weeks from today. In
the event, such representation is filed along with certified copy of this order, the opposite
party no.3 would do well to dispose of the same by passing a reasoned order in accordance wit
h law within a period of six weeks from the date of receipt of such representation. This Court
directs that in the event opposite party no.3 comes to a conclusion that the petitioner is ot
herwise eligible to be appointed as a part time instructor, he shall pass necessary orders.
The writ application is accordingly disposed of.
