2. The petitioner has prayed for a direction to the opposite parties 4 and 5 to reimburse
the medical expenses to the tune of Rs.2,50,000/- undertaken by him to save his life in conso
nance with the Office Memorandum of opposite party no.1 under Annexure-6.
3. It is submitted by the learned counsel for the petitioner that the petitioner is an Ex
-serviceman who joined the Ex-serviceman Contributory Health Scheme (in short the ECHS). She f
urther submits that the petitioner had undergone a cardiac surgery at Fortis Escorts Heart Ins
titute with proper intimation to opposite party no.4. After the surgery, the petitioner made r
equest to the opposite party no.4 to meet the expenses because the petitioner not only covered
by ECHS but also has got the cashless facility. According to the norms of Ministry of Health
and Family Welfare and Ministry of Defence, an Ex-serviceman is entitled to certain treatment
and reimbursement of the medical expenses as per the slabs mentioned therein.
4. Learned counsel for the petitioner further submits that since the petitioner has under
gone treatment for fixation of Dual Chamber ICD Implant, he has to pay a sum of Rs.2,50,000/-
to the Fortis Escorts Heart Institute besides other expenses. So, she prays for reimbursement
of such medical expenses in his favour.
5. Mr.Mohanty, learned Central Government Advocate, by referring to counter and Annexure-
9, submits that although the regional Centre ECHS-I recommended only for single chamber ICD im
plant, the petitioner had undergone fixation of dual chamber ICD implant for which they have r
