ior Division), Cuttack in Money Suit No. 34 of 1991 decreeing the same filed by the opposite p
arty as plaintiff.
The appeal had been dismissed on 22.01.1997 for non-removal of defect i.e. non
-filing of limitation application despite peremptory order dated 03.01.1997.
Learned counsel for the petitioner submits he has no further instruction in th
e matter.
In view of above, the application stands dismissed.
