It is stated on behalf of the learned counsel for the petitioner that the petitioner ha
s intimated them near about four days back to take back the brief from them as the conducting
counsel is not in a position to argue this matter. On earlier occasion, this Court had called
for the L.C.R. and specifically adjourned this matter to today. L.C.R. in this case has alread
y been received. In such view of the matter, this Court feels that the petitioner is a recalci
trant litigant and, as such, this CRLMC stands dismissed for non-prosecution.

Interim order dated 14.01.2010 passed in Misc. Case No.3106 of 2009 stands vacated.

L.C.R. received be sent back forthwith along with a copy of this order.
