nd learned counsel for opposite party no.2.
2. This is an application under Section 482 of Cr.P.C. to quash the proceeding in G.R Cas
e No.398 of 2008 arising out of Pattamundai P.S Case No.184 of 2008 pending before the Court o
f learned J.M.F.C., Pattamundai.
3. The informant-opposite party no.2 has filed an affidavit on 28.01.2011 under Annexure-
4 stating that he does not want to proceed with the case, as the matter has been settled betw
een the parties out of Court. The prosecution has also no objection.
4. Since all the parties are not interested to prosecute the case any further, this Court
feels that no fruitful purpose would be served by allowing the criminal proceeding to continu
e as there is bleak chance of success. To sub-serve the interest of justice and to prevent abu
se of the process of Court, the proceeding in G.R Case No.398 of 2008 arising out of Pattamund
ai P.S Case No.184 of 2008 pending before the Court of learned J.M.F.C., Pattamundai is quashe
d.
The CRLMC is accordingly disposed of.
