Standing Counsel for the School and Mass Education Department.
This contempt application has been filed for non-compliance of the order dated 07.12.2
015 passed by this Court in W.P.(C) No.21541 of 2015.
Mr. B. Satpathy, learned counsel for the petitioner submits that though the authority
disposed of the representation of the petitioner in compliance of the order dated 07.12.2015 p
assed by this Court in W.P.(C NO.21541 of 2015, it was not passed in conformity with the judgm
ent passed by this Court in Bibekananda Dash v. State of Orissa and others, 1997 (II) OLR 122.
Mr. A.K. Pandey, learned Standing Counsel for the School and Mass Education Department
submits that since the representation of the petitioner has been considered, contempt proceed
ing cannot sustain.
Considering the contentions raised by the learned counsel for the parties and after go
ing through the records, since the representation of the petitioner has been considered by the
authority, this amounts to compliance of the order passed by this Court. In any case, if any
cause of action survives, the petitioner is at liberty to approach the appropriate forum.
Contempt petition is hereby dropped.
