T he allegation against the petitioner is that he was insisting the deceased to get Ac.0.10 deci mals of land located in road side in village of his father-in-law registered in his name and a lso the petitioner did not protect the deceased from the cruelty meted to her by her in-laws i ncluding the sexual harassment by her father-in-law and brother-in-law and kept mum on the sam e. It appears that in this case investigation has been completed and charge-sheet has already been filed. Nothing is there on record indicating the fact that the petitioner, who is serving in Railway Department, shall abscond and/or tamper with the prosecution evidence, if released on bail.

Therefore, regard being had to the aforesaid facts and submissions made, especially the nature of accusation, character of evidence appearing against the petitioner in support of th e charge, circumstances in which the offences said to have been committed, factum of completio n of investigation and hardly any material being there to suggest that the petitioner is likel y to abscond and/or tamper with the prosecution evidence, if released on bail, I am of the vie w that the petitioner in this case deserves to be released on bail.
