07. 03.07.2017 Learned counsel for the petitioner submits that the pe
titioner does not want to press this CRLMC, but he may be given liberty to file a petition und
er Section 205 of the Cr.P.C. before the court below for dispensing with his personal attendan
ce.
Considering the facts and submissions made, this CRLMC stands dismisse
d as not pressed. The petitioner is at liberty to file the petition as submitted. In the event
of filing of the aforesaid petition, the court below shall consider and dispose of the same t
aking note of the fact that issuance of the N.B.W. does not stand on the way of the court to c
onsider a petition made under Section 205 of the Cr.P.C. and also allow the same, if the court
thinks the same to be fit.
Interim order passed earlier stands vacated.
This order be communicated to the court below forthwith.
