In the light of the order passed by this Court in the case of Pramod Kumar Ra y and others vrs. State of Odisha (ABLAPL No. 18056 of 2016, disposed of on dtd.10.05.2017), t his ABLAPL is disposed of with the following observations.

The petitioner shall surrender before the learned Sessions Judge-cum-Special J udge, Nuapada in C.T. Case No. 114 of 2017 corresponding to Sinapalli P.S. Case No. 60of 2017 within 7 (seven) days from the date of re-opening of the Court after the ensuing Summer Vacat ion. The petitioner, if so desires, may surrender before the learned Sessions Judge-cum-Specia l Judge, Nuapada, if the said Court is in seisin over the matter during the Summer Vacation. Seven days before the petitioner surrenders before the said Court, he or his counsel shall ser ve a copy of the bail application or such number of copies of the bail application on the lear ned Public Prosecutor/ Special Public Prosecutor, as required by him, for the purpose of notic e to the victim or his/her dependent.

Taking into consideration the nature of the offence as alleged against the pet itioner, it is directed that the petitioner shall be released on interim bail by the learned S essions Judge-cum-Special Judge, Nuapada on the same day he surrenders in the aforesaid case, pending disposal of the bail application, on merit, at the time of final hearing of the case, on such terms and conditions as deemed just and proper, including the following conditions :-

(1) the petitioner shall appear before the I.O. once in a week on the day and time fixed by t he said I.O. till submission of Final Form or till commencement of trial, whichever deem fit a nd proper by the Trial Court.
