Heard learned counsel for the petitioners and learned Addl. Govt. Advocate.
The petitioners are villagers of two villages namely Kundapitha and Kalkath under Ba
saloi Grama Panchayat in the district of Deogarh. They want that a new Grama Panchayat by tak
ing villages Kundapitha, Kalkath and Kudanali be created, as the population of the said three
villages is about 2900. It is further submitted that, with a population of 2000, a separate P
anchayat has been created by the Government. The petitioners further submit that, there is ad
ministrative inconvenience and geographical barriers so far as their old G.P. Basaloi is conce
rned. Therefore, they want that all the aforesaid three villages, namely Kundapitha, Kalkath
and Kudanali should constitute a new and separate Grama Panchayat.
Taking into consideration the limited grievance of the petitioners and without going
into merit of the case, this writ petition is disposed of with the direction that the petitio
ners shall file a detailed representation along with the certified copy of this order and a co
py of the writ petition containing all the Annexures before the Commissioner-cum-Secretary to
the Govt. in Panchayati Raj Department within 15 (fifteen) days from today.
Learned Commissioner-cum-Secretary, Panchayati Raj Department is directed to conside
r the grievance of the petitioners within four weeks from the date of receipt of the certified
copy of this order. The petitioners and other concerned parties may be given opportunity of
being heard in the matter, and a reasoned order in consonance with the guidelines of the Gover
nment be passed by the learned Commissioner-cum-Secretary, P.R. Department.
The writ petition is accordingly disposed of.
