The petitioners have filed this writ petition with a prayer to direct the Assist
ant Settlement Officer, Bhubaneswar, Opposite party no.4 to consider and take a decision in Ob
jection Case No.4995/13/4227.
Considering the limited request involved in this matter, the writ petition stand
s disposed of with a direction to the opposite party no.4 to take a decision in Objection Case
No. 4995/13/4227, as appearing at Annexure-7, within a period of four months from the date of
receipt of a copy of this order after affording opportunity of hearing to all concerned.
Issue urgent certified copy of this order on
proper application.
This writ petition is filed assailing the orders vide Annexures-10 and 13, whic
h were passed in the year 2006 and 2011 respectively.
It appears, the opposite party no.1 was already 64 years on the date of filing o
f the writ petition and there is no dispute that he has been retired long since.
Under the circumstances, no purpose will be
solved in entertaining this writ petition after such a long period of time and further keeping
in view that the opposite party no.1 has already been retired long since, this will be a vexa
tious litigation. This Court does not find any merit in the writ petition.
Accordingly, the writ petition stands dismissed for having no
merit.
