Petitioner in this writ petition seeking for a direction to the opposite parti es to release the utilization amounts of LED street light for installation and purchase by two Panchayats i.e. Dalab Grampanchayat and Kadobahal Grampanchayat as per the decision of the Ce ntral and State Government within a stipulated time.

It is contended that petitioner is a dealer of M/s. N.N.S.Power Limited who ha s supplied LED light to all over Orissa is registered under District Industry Center Orissa, B hubaneswar. The Director, Panchayatraj by its letter dated 2.11.2015 directed all the Collecto rs/Project Directors, DRDAs/Block Development Officers/District Panchayat Officers for install ation of street lights (LED Lights) in the village by the G.Ps as per the recommendation of 4t h State Finance Commission and 14th Central Finance Commission prepared by Central Electricity Supply Unit of Odisha. Thereafter petitioners has entered into an agreement before installati on of LED light with Panchyat after selected as Bidder to supply LED light to various Panchaya ts. Some Panchayats like Lahanda, Kultatikra installed street LED light and there utilization amount has already been released but utilization amount in respect of two Panchyats namely, Ka dobahal Panchyat of Attabira Block and Dalob Panchayat of Bhedan Block of Bargarh has not been released till date. Petitioner has supplied the materials as per the decision of the aforesai d Gram Panchyat and work order obtained from the Gram Panchyat. While the matter stood thus th e State Government vide its letter dated 14.2.2016 directed to all the Collectors/Project Dire ctors, DRDAs/Block Development Officers/District Panchayat Officers to stop installation of st reet light till the instruction in this regard. Thereafter petitioner has filed representation before Collector, Bargarh on 15.1.2016 to take appropriate step for disbursement of his legit imate dues. As no action has been taken on the representation hence the present writ petition.

Considering the above this Court disposes of the writ petition with an observa tion that in case the petitioner files representation before opposite party Nos. 2, 3 and 4 wi thin a period of four weeks from today in such event the representation of the petitioner shal l be considered within a period of four weeks from the date of filing of such representation i n accordance with the direction issued by the Panchayatraj Department on 2.11.2015. The above exercise shall be completed on production of the certified copy of the order.
