2. The petitioner had taken a loan for purchase of a tractor for which he paid ce
rtain installments, but thereafter there was default for certain reasons beyond the control of
the petitioner. Although there is no notice for recovery issued against the petitioner, yet t
he petitioner has filed this writ petition with a prayer that he may be furnished with the det
ails of the loan account so that the same may be cleared by the petitioner.
3. On having received instructions, Shri Tuna Sahu, learned counsel for the Bank
has stated that as on 30.04.2016 the amount due from the petitioner is Rs.2,68,209 + interest
approximately Rs.67,180/- which comes to Rs.3,35,389/-.
4. Learned counsel for the petitioner states that if the Bank waives the interest
amount, the petitioner would be ready and willing to clear the entire outstanding dues in one
go.
5. In view of the aforesaid, we dispose of the writ petition with the direction t
hat the petitioner may apply for One Time Settlement of his dues to the Bank by filing an appl
ication within fifteen days from today. The Bank shall consider and decide the said applicatio
n of the petitioner in accordance with law within three weeks thereafter. In case the Bank wai
ves the interest, the petitioner would be given one month time to deposit the entire amount. H
owever, it is provided that in case the entire amount with interest is directed to be paid, th
en the Bank may fix installments for payment of the aforesaid amount.
With the aforesaid observations/directions, the writ petition is disposed of.
