5. Mr Sahu, learned counsel for the Bank submits that since the property mortgage
d is already notified to be auctioned on 06.05.2016, the petitioner may be directed to deposit
some reasonable amount prior to that date after which the Bank would regularize the account o
f the petitioner on payment of balance overdue amount.
6. Having heard learned counsel for the parties and considering the facts and cir
cumstances of the case, we dispose of the writ petition with the direction that in case the pe
titioner deposits a sum of Rs.2.00 lakh with the opp. party-Bank on or before 05.05.2016 and f
iles an application for being provided with the details of the overdue amount of installments,
the Bank shall thereafter ensure that the auction of the mortgaged property shall not be held
on 06.05.2016. The Bank shall also provide to the petitioner the details of the loan account
of the petitioner including the overdue installments up to May 2016 by 20.05.2016. The petitio
ner shall within fifteen days thereafter pay the overdue installments and thereafter the Bank
shall regularize the account of the petitioner on requiring the petitioner to pay the balance
amount in installments as had been originally fixed by the Bank at the time of grant of loan.
It is made clear that incase the petitioner fails to deposits any of the amounts indicated abo
ve, this order shall automatically stand withdrawn. It is also clarified that if the petitione
r does not deposit Rs.2.00 lakh on or before 05.05.2016, the auction proceeding shall take pla
ce.
