el for O.P.1, Mr.N.Panda, learned counsel for O.P.2 and Mr.R.K.Swain, learned counsel for the
private O.P.3.
2. This writ petition has been filed seeking a direction against O.P.2-Executive Officer,
Baripada Municipality, for demolishing the deviation made by O.P.3.
3. In substantiating the judgment, Sri Mishra, learned counsel for the petitioner, by bri
nging to the notice of this Court several documents in the writ petition, submitted that follo
wing a plan by the petitioner for deviation in the building planning by O.P.3, this Court in d
isposal of the writ petition being W.P.(C) No.19771/2015 directed the Collector, Mayurbhanj to
consider the representation of the petitioner and following the direction of this Court, as a
bove, the Collector, Mayurbhanj took up the matter and by order dated 31.12.2015 disposed of t
he representation of the petitioner directing the Executive Officer, Baripada Municipality to
make an enquiry to find out the deviation as actually taken place or not. Consequent upon such
direction of the Collector, a report is submitted by the Executive Officer, Baripada Municipa
lity as appearing at Annexure-5 finding deviation by the petitioner as well as O.P.3 in their
respective buildings.
