3. 13.09.2016 Looking to the submission of Sri Bose, learned coun
sel appearing for the petitioner, this Court finds the ground can very well be considered by t
he appellate authority. Since the petitioner has a clear remedy of appeal, the writ petition
stands withdrawn with liberty to the petitioner to approach to the appellate authority.
As the petitioner is pursuing a wrong writ remedy, let an appeal be filed with
in a period of ten days from the date of the order along with an application for condonation o
f delay indicating that the petitioner was pursuing wrong remedy of appeal, in such event the
delay shall be condoned and the appeal shall be heard on its own merit.

On oral prayer, certified copy of Annexure-
1 be returned to the petitioner by filing a substituted copy thereof.
