02. 01.12.2016 Learned counsel for the petitioner submits that pursuant to th e decision of the Department of School and Mass Education as regards engagement of Part Time I nstructors in Physical Education vide Annexure -4 the petitioner has been provisionally select ed by the District Selection Committee duly approved by Collector and her name finds place in sl. 23 of the provisional merit list under Annexure -3 in so far as the Jajpur district is con cerned. He further contends that such selection of the petitioner is subject to the approval o f the Director of Sports and Youth Services.

Placing before this Court that a representation to that effect for considerati on has already been filed by the petitioner, he now prays for disposal of the writ application with a direction to opposite party no. 2 to consider the same under Annexure -6 in the matter of according; necessary approval for the purpose of engagement of the petitioner as part time instructor (Physical Education (un-trained)) in Jajpur district. He also contends that the ce rtificate that has been issued in favour of the petitioner is with respect to a game which has been affiliated to the National Federation/ Association duly recognized by Sports Youth Affai rs, Government of India.

Considering the submissions and viewing the limited prayer as is now advanced without expressing any opinion on merit, this writ application is disposed of with a direction to the opposite party no. 2 to consider the Annexure -6 on its own merit and dispose it of in accordance with law within a period of four weeks from the date of communication of this orde r or production of its certified copy whichever is earlier.
