13. 17.11.2016 Learned counsel for the petitioners submits to have no
instruction in the matter for further pursuing this application.
Learned counsel for the opp.party submits that in the meantime petitio
ner no. 1 has died and as per his instruction, rest of the petitioners have already parted wit
h the subject matter of the suit which is one for permanent injunction.
In view of the above, the application stands dismissed for non-prosecu
tion.
