The petitioner who is working as Lecturer in English (2nd post) in Derabis Col
lege, Derabis in the district of Kendrapara has filed this application seeking for a direction
to opposite party nos. 1 and 2 to approve this appointment w.e.f. 28.11.1992 in terms of the
judgment of this Court in case of Bilkesh Parveen Vrs. State (OJC No. 4199 of 2000) affirmed b
y the Apex Court in Civil Appeal No. 2401 of 2011 disposed of on 20.08.2015.
Mr. Sahoo, learned counsel submits that the grievance of the petitioner is cov
ered by the ratio of the decision of this Court in Bilkesh Parveen (supra) which has been conf
irmed by the Apex Court in Civil Appeal No. 2401 of 2011 decided on 20.8.2015.
Mr. A.K. Mishra, learned Additional Govt. Advocate submits that the case of th
e petitioner cannot be said to be similarly situated with the cited case.
In view of the above without expressing any opinion on the merit of the case,
the writ application is disposed of with the observation that in case the petitioner files rep
resentation before the opp. party no. 1 within three weeks from today describing his grievanc
e along with true Xerox copies of the decisions of this Court and Apex Court (supra), the said
opposite party no.1 shall examine the case of the petitioner in the light of the ratio decide
d in the aforesaid cases and if it is found that he is squarely covered by the aforesaid decis
ion, it shall pass necessary orders in accordance with law as expeditiously as possible prefer
ably within a period of four months from the date of filing of such representation.
The writ application is accordingly disposed of.
Urgent certified copy of the order be granted on proper application.
