The petitioners name was considered by the Grama Panchayat, Injidi along with
others, who applied for the post of Preraks in the flagship literacy scheme Sakshara Bharat. I
t is apparent from Annexure-3, i.e. the resolution of the Injidi Grama Panchayat dated 16.03.2
016, that out of nine candidates, three candidates, namely, Priyankarani Sahu, Fulamani Behera
-present petitioner and Padmanava Sahu were recommended to be appointed as Preraks. However, w
hile forwarding the names of the persons, who are eligible to be considered for the post of Pr
eraks, the Headmaster of Injidi U.P. School, Pallahara wrote to the Block Education Officer th
at the persons, namely, Priyankarani Sahu, Ritanjali Pradhan, Ranil Kumar Sahu, Lalita Pradan,
Ani Swain and present petitioner-Fulamani Behera should be considered.
The learned counsel for the petitioner submits that the action of Sibeswar Nai
k, the Headmaster of the aforesaid U.P. School is contrary to the resolution passed by the Gra
ma Panchayat and therefore the illegality committed by him should be enquired into and the nam
e of the three persons, namely, Priyankarani Sahu, present petitioner and Padmanava Sahu shoul
d be considered.
