02. 13.09.2016 This writ petition has been filed with a prayer to qua
sh the status of the forest offences against the Saw Mill of the petitioner submitted by Fores
t Range Officer, Dalijora Range, Byree on 25.08.2015 under Annexure-4 and for a direction to t
he opp.party to issue license in favour of the petitioners Saw Mill in the name and style of
M/S Mother India Saw Mill for rehabilitation of the Saw Mill of the petitioner as per the Or
issa Saw Mill and Saw Pits (Control) Amendment Act,2010.
Learned counsel for the petitioner has drawn the attention of this Cou
rt to paragraph-14 of the writ petition wherein it is mentioned that after acquittal order pas
sed by the learned J.M.F.C., Chandikhol in 2(b) CC No.12 of 2012, the petitioner has represent
ed before the Principal Chief Conservator of Forest Orissa -Cum- Chairman Committee on Saw Mil
l (opp.party no.3) for condoning the offences and for a direction to issue a license in favour
of the petitioner. As per the direction of opp.party no.2, the Forest Range Officer, Dalijor
a Range, Byree submitted a status of the forest offences against the Saw Mill of the petitione
r on 25.08.2015 indicating that 17 numbers of offences were alleged against the petitioner fro
m the year 1981 to 2009. Learned
