Heard learned counsel for the petitioner and Miss Sanjibani Mishra, learned Addl. Stan
ding Counsel.
This writ petition has been filed by the petitioner alleging commission of irregularit
ies by the opposite parties in the matter of allotment of Indira Awas Yojana. According to him
, the authority ought to have adopted a fair and transparent policy for allotment of house und
er Indira Awas Yojana, but the benefit has been extended ignoring the case of the petitioner w
ho stands above in the list of eligible beneficiaries who have been found to be eligible to ge
t the benefit under the Scheme and ignoring his case, who are below in the list has been exten
ded the benefit of Indira Awas Yojana.
According to the petitioner, he has raised grievance before opposite party no.3-the Pr
oject Director, DRDA, Balasore, but to no effect.
Learned counsel for the State has submitted that the writ petition may be disposed of
directing the opposite party no.2 to take decision in accordance with law.
On such submission and without entering into the merit of claim of the petitioner, the
writ petition is disposed of giving liberty to the petitioner to file fresh representation be
fore opposite party no.2-the Collector, Balasore giving therein all details of claim supported
by relevant documents, if any within two weeks from the date of receipt of copy of this order
.
Concerned opposite party shall cause an enquiry in order to ascertain the truth and if
it is found that irregularities has been committed, the same shall be set at
rest forthwith.
Opposite party no.2 is directed to complete the exercise within four weeks from the da
te of receipt of copy of the representation.
Accordingly, the writ petition is disposed of with the observation and direction made
herein above.
