Learned counsel for the petitioner submits that the petitioner is ready and willing t
o deposit 50% of the disputed amount after adjusting pre-deposits are made.
Having heard the learned counsel for the respective parties and on perusing the impug
ned order, we are of the considered view that ends of justice would be best met if directions
are issued to the petitioner to deposit 50% of the disputed tax amount after adjusting any pre
-deposits within a period of four weeks from today and on such deposits, the balance demand sh
all remain in abeyance till disposal of the Second Appeal. We direct accordingly. We further d
irect that after the aforesaid deposit is made, hearing of the Second Appeal may be expedited
and dispose of the same at an early date in accordance with law.
With the aforesaid observation and direction, the writ petition stands disposed of.
Urgent certified copy of this order be granted on proper application.
Free copy of this order be handed over to the learned counsel for the Revenue.
