14.01.2016 This appeal is directed against order dated 27.07.2006 passed by the learned C
ivil Judge (Senior Division), Anandpur in C.M.A. No.4 of 2006 arising out of T.S. No. 13 of 20
02 dismissing an application under Order 39 Rules 1 and 2, CPC.
This Court, while issuing notice in the matter on 15.09.2006, directed to main
tain status quo as on that date in respect of the suit land till next date. The suit is of the
year 2002 and the interim order was passed on 15.09.2006. Taking into consideration the age o
f the suit as well as the date on which the interim order passed by this Court, for the intere
st of justice, it would be just and proper to direct the learned Court below for early disposa
l of the suit.
In that view of the matter, this Court directs, if the suit is pending, the sa
me shall be disposed of as expeditiously as possible, preferably by end of August, 2016. Till
then status quo in respect of the suit property shall be maintained by the parties.
With the aforesaid observation, the appeal stands disposed of.
