02. 26.10.2016 This civil miscellaneous application has been filed for restor
ation of writ petition being W.P.(C) No.7896 of 2008 which has been dismissed for default vide
order dtd.18.3.2016.
Learned counsel for the petitioner has stated in the application that due to h
is illness none represented the petitioner on the date fixed and as such due to bona fide mist
ake on his part the writ petition has been dismissed and if the writ petition will not be rest
ored, the petitioner will suffer irreparable loss.
Learned counsel for opposite party has got no objection.
Accordingly and considering the reason mentioned, the CMAPL is allowed. W.P.(C
) No.7896 of 2008 is restored to its original file.
