03. 03.10.2016 Heard the learned counsel for the petitioner and the l
earned counsel for the State.
The petitioner being in custody in G.R. Case No.970 of 2016 arising out of Chh
endipada P.S. Case No.134 of 2016 pending in the court of learned SDJM, Angul, has filed this
petition for his release on bail. The offences alleged against him are punishable under Sectio
ns 379/34 of IPC.
Considering the facts and submissions made, especially the nature of accusatio
n, character of supportive materials appearing against the petitioner in support of charge, ci
rcumstances in which the offence alleged to have been committed and hardly any material being
there to suggest that the petitioner is likely to abscond or tamper with the prosecution evide
nce, if released on bail, I am of the view that the petitioner in this case deserves to be rel
eased on bail.
Hence, the petitioner be released on bail in the aforesaid case by the court i
n seisin over the matter on such terms and conditions as the court concerned may deem just and
proper.
Accordingly, the BLAPL is disposed of being allowed.
Urgent certified copy of this order be granted on proper application.
