3. The petitioner, apprehending his arrest on the strength of the NBW issued by t
he learned S.D.J.M., Jajpur in G.R. Case No. 263 of 2000 wherein cognizance of offence under S
ection 498-A/304-B/34 IPC and Section 4 of the D.P.Act has been taken, has approached this Cou
rt with this application under Section 438 of Cr.P.C.

 Learned counsel for the petitioner drawing the attention of this Court in the
statement of the informant and others contends that they have clearly stated the deceased to h
ave committed suicide by consuming poison. They have also not stated anything attributing any
such role to the petitioner in the incident in exerting the deceased with cruelty in any manne
r so as to draw any further inference as regards the ultimate death. He also submits that in t
he meantime, the husband of the deceased has already been released on bail and this petitioner
 is the elder brother of the husband of the deceased. Thus, in the absence of any other impedi
ment, on the aforesaid materials, he urges for grant of anticipatory bail to the petitioner.

 Learned counsel for the State fairly places the statements of the informant an
d another who have stated about the commission of suicide by the deceased without attributing
any such role in the incident to this petitioner.

 Considering the above submission, in view of the materials available on record
 and as no such impediment stands, this Court is inclined to grant anticipatory bail to this p
etitioner and accordingly direct that in the event, the petitioner surrenders in the court bel
ow or he is produced by the police in the case on the strength of the NBW, he shall be release
d on bail with such terms and conditions as the said court would deem fit and proper.
 ABLAPL is accordingly disposed of.
