22.11.2016 Heard learned counsel for the petitioners and learned Addl. Government
Advocate.
The petitioners are apprehending arrest for the alleged commission of
offence under Sections 294, 323, 506/34 of the IPC in G.R. Case No.730/2016 of the court of l
earned SDJM, Padampur, arising out of Jharbandha P.S. Case No.116/2016.
The petitioners are permanent residents of Deogaon, P.S. Tushura, Dist
. Bolangir, which precludes any chance of their absconding from justice. There is no allegati
on on behalf of the prosecution that the petitioners shall tamper with the prosecution evidenc
e if released on bail.
Keeping in view the aforesaid consideration, the ABLAPL is allowed. I
n the event of their arrest in the aforesaid case, the petitioners shall be released on bail b
y the arresting officer on such terms and conditions as deemed just and proper by him.
The ABLAPL is disposed of.
