16.11.2016 Heard learned counsel for the petitioners and learned Additional Gover
nment Advocate for the State.
The petitioners are apprehending arrest for the alleged commission of offence
under Sections 341, 294, 323, 354 and 379/34 of the IPC in G.R. Case No.381 of 2016 of the cou
rt of learned J.M.F.C., Chandbali, arising out of Chandbali P.S. Case No.174 of 2016.
The petitioners are permanent residents of village Kandagaradi, P.S.-Chandbali
, Dist.-Bhadrak and there is no chance of their absconding from justice. There is no allegatio
n on behalf of the State that the petitioners will tamper with the prosecution evidence, if th
ey are released on bail.
Keeping in view the aforesaid consideration and the facts of the case, applica
tion for anticipatory bail is allowed. In the event of arrest of the petitioners in the afores
aid case, they shall be released on bail by the arresting officer on such terms and conditions
as deemed just and proper by him.
The ABLAPL is disposed of accordingly.
