01.11.2016 Heard learned counsel for the petitioners and learned Additional Stand
ing Counsel for the State.
The petitioners are apprehending arrest for the alleged commission of offence
under Sections 143, 427, 384, 294 and 506/149 of the IPC in C.T. Case No.3667 of 2016 of the c
ourt of learned S.D.J.M., Bhubaneswar, arising out of Nayapalli P.S. Case No.268 of 2016.
None of the offences are punishable with terms of imprisonment exceeding seven
years. The petitioners are permanent residents of Saheed Laxman Nayak Basti, Rental Colony, P
S-Nayapalli in the district of Khurda and there is no chance of their absconding from justice.
There is no allegation on behalf of the State that the petitioners will tamper with the prose
cution evidence, if they are released on bail.
Keeping in view the aforesaid consideration and the facts of the case, applica
tion for anticipatory bail is allowed. In the event of arrest of the petitioners in the afores
aid case, they shall be released on bail by the arresting officer on such terms and conditions
as deemed just and proper by him.
The ABLAPL is disposed of accordingly.
Urgent certified copy of this order be granted as per rules.
