nment Advocate for the State.
The petitioners are apprehending arrest for the alleged commission of offence
under Sections 147, 148, 379, 323, 294 and 506/149 of the IPC in C.T. Case No.757 of 2016 of t
he court of learned J.M.F.C., Soro, arising out of Khaira P.S. Case No.163 of 2016.
The petitioners are permanent residents of village Sanakumari, PS-Khaira in th
e district of Balasore and there is no chance of their absconding from justice. There is no al
legation on behalf of the State that the petitioners will tamper with the prosecution evidence
, if they are released on bail.
Keeping in view the aforesaid consideration and the facts of the case, applica
tion for anticipatory bail is allowed. In the event of arrest of the petitioners in the afores
aid case, they shall be released on bail by the arresting officer on such terms and conditions
as deemed just and proper by him.
The ABLAPL is disposed of accordingly.
