11.1.2016 Learned Addl. Government Advocate, on instruction, submits that in the mean time Ku
akhia P.S. Case No.176/2015 has been registered against the present petitioner for the alleged
 commission of offences under Section 498-A/323/506/34 of the I.P.C.

2. Heard learned counsel for the petitioner and learned Addl. Government Advocate for the
State.

3. It is apparent from the record that there is no serious allegation of any physical ass
ault on the person for the informant. The non-bailable offences involved in this case are unde
r Sections 498-A/506 of the I.P.C., which are not punishable with terms of imprisonment exceed
ing seven years. So the offences come within the ambit and purview of Section 41 of the Cr.P.
C.

4. Keeping in view the aforesaid consideration, nature of the allegations made and the fac t that the petitioner is permanent resident of village Keutalaguan, P.S.-Kuakhia, in the distr ict of Jajpur and there is no chance of his absconding from justice, application for anticipa tory bail is allowed. In the event of arrest of the petitioner in the aforesaid case, he shall be released on bail by the arresting officer on such terms and conditions as deemed just and proper by him.
