The petitioner is apprehending arrest for the alleged commission of offence un
der Section 395 of the IPC in G.R. Case No.1223 of 2014 of the court of learned S.D.J.M., Samb
alpur, arising out of Ainthapali P.S. Case No.150 (2) of 2014.
It is apparent from the record that the informant, Narendra Biswal has not imp
licated the petitioner either in the FIR or in his statement recorded under Section 161 of Cr.
P.C. However, the petitioner has not been charge sheeted. It is further apparent from the reco
rd that there is dispute between owner of two private busses and staff of one bus assaulted th
e conductor of the other bus and it is alleged that they have taken some money from the conduc
tor. So, this Court is of the opinion that since no specific allegation against the present pe
titioner. In the meantime charge sheet has been submitted.
Keeping in view the aforesaid consideration and the facts of the case, applica
tion for anticipatory bail is allowed. The petitioner is given liberty to surrender before the
learned S.D.J.M., Sambalpur within 21 working days in connection with the aforesaid case and
apply for bail. On such event, he shall be released on bail on such terms and conditions as de
emed just and proper by the learned Magistrate.
It is further directed that on the event the petitioner is arrested in the mea
ntime, the Arresting Officer shall produce him before the learned S.D.J.M., Sambalpur within 2
4 hours and the learned Magistrate shall grant him bail as directed above.
The ABLAPL is disposed of accordingly.
